To capture a human soul u need a Black Soul Gem. To do this put a empty grand soul gem in a necromancer alter, and when the "lights from the heavens" shine on the alter, cast a Soul Capture spell at the alter. Congrats you have a black soul gem.

The same thing happend to me, so all i did was wait 24 hours and jearl was on the other side of the stones. So i killed him too , but if that doesnt work you can try an wait at jearls house untill he arrives.
