Well, it took a while to contemplate this, especially with college on the brain.
Don't you think that the comedy of the gargoyle falling on Remus would make 'Diehard" a more unlikely feat? Besides, with the way that he's still very conscious while the gargoyle's on him makes me think that he is hardly close to dying. For all you know, he's at 1 hit point, if not 10. Also, his lycanthrope damage reduction may have absorbed some of that crushing damage, so the statue may have become less than fatal as well.
Remus defintely seemed like he started that entire encounter at full health. When combat actually was underway, he only seemed to have really taken a scratch from Durnkrag's axe, so he may have only lost one health point at least, and 12 at the most. If he was at 85 to start, and then from 84 to 75 after that axe attack, then that 400-something-pound gargoyle fell about 20 to 40 feet, which would have caused 3d6 or 4d6 damage, so it would be 18 or 24 damage -10. These calculations are according to the table and entry for falling objects in the 3.5 Dungeon Master's Guide (and yes, I do have a copy of that). Durnkrag is about 5th-level, which leaves him with a Base Attack Bonus of +5, and with his Strength bonus of (probably) +3; he'd have +8 (or +9 if his Strength is 18). Now, if he's got a regular battleaxe, which is a 1d8 weapon, then 'Krag could be making up to (wild guess) 30 damage. Still, by the look of that, 10 damage was ignored, so Remus might have taken anywhere from 20 to 8 points of damage by Durnkrag. If my calculations are correct, Remus is a bit far from dying, in this case. Maybe he is low on hit points and prone, but not not bleeding to death (if that was the case, it could have been internal).
In short, it may be likely that Remus was low on hit points, but not dying. Still, like we've all said, this is still very debatable.
