Depends on your mod/patch status. If you've installed temple.zip, for instance, this removes the level 10 cap. If you are running just patches 2 and 3, that won't. There's also a front-end program that lets you turn off the level cap. But basically it was designed with the cap, and this was removed by many modders who wanted to go higher (and who felt those who wanted the cap could just stop levelling their guys once they hit 10th level).

Well, from the name you give, that's the very first official patch. That won't remove the level cap.
What you want to do is this.
1. Apply patch 2. You can do that on top of patch 1, no worries.
2. Apply temple.zip. This will remove the level cap. Your saved games should be just fine, so long as you don't have any metamagic stuff going on with your spellcasters.

1. Unzip the patch. (Double click the folder you downloaded and choose the extract all files option in the corner of the window (XP))
2. Find the file in you GAME'S directory called "temple.dll" and remove it. (Put it somewhere you can find it again.)
3. Take the "temple.dll" file from the unzipped patch folder and put it where the original file was.
4. Inside the patch folder should be a folder called "data". Inside that folder should be three new folders. Take all of them and put them into the game's "data" folder.
After that, you should be all set. Game should run more stable, and there will be no level cap. Plus a whole bunch of other problems were fixed.

Okay, so the deal is this. Patches 1 and 2 fix bugs and issues all over the place, and the fixes are good. Patch 2 includes patch 1, so you don't really need 1 at all any more. Patch 3, on the other hand, was a fix for just one problem: the looting bug for windows XP service pack 2. That's all it did. There was already a fan-made patch available (temple.zip) that fixed this problem and more besides. Thus, patch 3 is pretty useless. The fan fix fixes more, so it's already the better option. But it doesn't stop there. All the fan mods out there (co8, Liv, Ted, Vicks and Wedge, etc.) are written for patch 2, and since 3 isn't necessary, none of these were or will be altered to work with patch 3. Thus, you have another reason to go with temple.zip: it'll be compatible with other mods, whereas 3 will not be. (Some mods require putting temple.zip after or include it themselves, and in that case, you can easily remove temple.zip by just putting the original temple.dll file back where it came from and removing the three new folders from the data folder. Voila! You're back to just patch 2, and the mods can be applied to that.
