A Japanese sea vessel found a recently dead Plesiosaurus in 1969, in the ocean, whose body had only recently begun decomposing. That means that there's a good chance Plesiosauruses still exist. Plesios are reptiles, but don't have to surface to breathe, so can be considered a marine animal. Thus, the plesiosaurus IS legal, though it isn't a fish, if the whale is legal.

But the whale isn't legal.

"if the whale is legal"? Are you refering to a whale shark that someone was using earlier? Whalesharks are sharks, not whales. Thus they are fish, whereas whales are not. Oh, and whales have to surface to breathe, just like dolphins do.
