KILL HIM!
Just be persistant and try to be behind him, as it happens i was sneaking and my sneak icon went off just before i picked it up but he didn`t notice

cast invis on yourself. you can usually grab an item without getting caught before you become visible.

I think Ylossakram said it in an earlier post on this thread...just jump up on the bed and take the sword. The guard is in full view the whole time, but I managed to get the sword without him raising an alarm or trying to kill me. It worked for me

I tried the aforementioned method, and failed multiple times, so I came up with a new one. I beat the guy on the head with a big stick until he fell down.

1) Enchant shortsword with lightning or fire bite.
2) Enchant shortsword further for shelter or improved agility with each hit.
3) Simmer until glowing a nice, hot red.
4) Serve with customary speed and relish to any daedric monstrosity you find.
Result: Shredded critter. High speed + enchantment = quick cusinart death.
