WRONG
Favored class is ignored in determining the XP penalty-like I said in the original post. For a human character-which is what I said I was talking about-the favored class will be rogue if no bard levels are taken until after the bard and fighter levels are gotten out of the way. With them finished and once bard levels are added in the XP penalty is going to check against the fighter and bard levels-until the bard levels exceed the rogue levels, after which favored class will switch to bard and it will check the fighter and rogue levels. Since the levels other than the favored class will at all times be as even as possible there will be no XP penalty.

You're talking about flanking and not backstabbing. If you have a rogue attack a target that's already engaged in melee combat you can get multiple flank attacks which get the backstab damage bonus. If you have your rogue backstab, that target and everything else in sight will lock onto your rogue. Since enemies in IWD2 tend to stay fixed on their first target your rogue loses all flanking opportunities as soon as you draw attention.
