i was wondering if there was a free and legal download of morrowind because im getting tiered of the xbox version, i hear there are some good mods out there and i would like to use them, but i dont want to use a torrent or anything illegal.

Not legally as far as I am aware. There are a few places to buy digital copies however. [url="http://store.steampowered.com/app/22320/"]Steam has it on sale for half off right now.[/url] Some don't care for Steam so Direct 2 Drive might be a better option, but you might want to do a quick search to see how easy it is to mod their version as they sometimes have their own unique executables for the games they sell and I don't know if Morrowind is one of those or not. I imagine there are other places to get copies, but those were the two that sprang to my mind first.

Unlike Morrowind and later, Daggerfall did not have a released creation kits. There are a few mods, mostly unofficial patches and the like, but there isn't really the modding scene that you get with newer games. Your best bet in cases like this is to search Google, but to get you started I'll point you at +++ Daggerfall Tool Repository +++ and Daggerfall Mods .
