What;s breaking the law?

Several times, in Balmora and Al'ruhn : attacked by racer in town and using enchanted item my char was accused - with all consequences 
... In one occasion it was area absorb health, i can see their point then, but other times it was soultrap and absorb health without area effect, just on target. Any ideas?
