Level 10?

Level 10 is the limit to ToEE. I have heard that maybe in a sequel the level cap would be higher.

It's not bad. Plenty of things in the game I don't like, but this isn't one of them. Consider: if you can only rise to level 10, then simple magical items you find are worth that much more, and low level spells you use have that much more effect. It's much easier to balance a game from a dev's viewpoint if both sides aren't packing napalm, too. 
This was the only respect in which I felt BG1 was superior to BG2. The low level cap made a small group of archers or a single white wolf a real threat. Dealing with them was a matter of strategy, not endless goodies. Each to their own, but that's my take on it.
