Staff of Magi patch?

I am soloing with a chaotic evil mage with Staff of Magi and whenever I summon I fiend it attacks me. I thought Staff of Magi was suppose to protect me from evil. Any patches or reasoning.

Well, casting Protection from Evil on an evil person seems kinda stupid. Since putting protecting from evil on an evil person is just protection from themselves
