I have a "good" character and it wont let me max out Berserk...i have it at lvl 3 right now and i have more then enough EXP points for it..
I've tried being max evil and it still wont let me...

It is because your 'alignment' is incorrect. I've had this problem before, you have to rebalance your alignment before you can max this out. There was another post just like this one, I think it was answered there.
