Actually, it is not a stupid question.
Even if your sneak skill is at 60 or above, and you have a chameleon spell running, it can be very difficult to pickpocket.
If you deperately need to pickpocket an item, and always get caught, this is what I suggest:
Cast a Mark spell in one of the thieve's guilds. Go off to pickpocket your item. The moment you get caught, cast Recall, and have the subsequent bounty on your head removed for a minimal fee.

Pickpocket

Use the 'sneak' facility ( CTRL ) and then hit SPACE on the character to be pickpocketed (the name/title of the victim must be visible)
Work if you are stealthy; stand behind and also try with invisible and/or cameleon

If you do a search on Sneak and Pickpocket, you'll find they have been covered quite extensively here.

However, the message you are getting is stating you can't train a skill beyond its controlling attribute. Sneak is governed by "Agility."
So, if your Agility is level 42, you will not be able to train Sneak beyond this number.
The way to get around it is simple. Other skills, such as Marksman, are also governed by agility. Train up ten levels in Marksman. When you level you will get a multiplier of 5 in Agility, select it, and thus raise your Agility score. This will allow you to train an additional five levels in Sneak.

You usually need a very high sneak skill to pickpocket succesfully. If you have a weak sneak skill and your on a quest to get an item from someone often it can be bribed away from them if you have enough money.

Though, usually, it is much cheaper to have the thieve's guild pay the bounty for getting caught than it is to bribe the NPC.
The exception is (spoiler, highlight below):
When you have to acquire the key for Nerano Manor. If you opt to get it off of the Dark Elf in the Council Club, you'll get your bribe money back, since you are likely to kill him in a subsequent quest.... ;)

I suspect that pickpocketing might depend also on Security - though not sure.
There are few things what help to pick pockets:
- have Agility boosted;
- have Luck boosted;
- try to pickpocket from behind or at least out of sight of your target (best if nobody looks to your side).
Sometimes it helps if something screens you from your target.
Altogether pickpocketing is most neat of sneak operations.

Now you come to mention I vaguely remember reading something similar in the manual, I can't confirm this for sure though as I'm at work.

*edit* OK just checked the manual and Loredweller is right ....
To steal an item from a person, you must first be in Sneaking. While sneaking, approach the person in question ... Since picking pockets is bsaed on your security skill ....
