the key to bring up the console depends on the keyboard you have. for example, on the uk keyboard its is the ¬ key (directly to the left of the 1 key) not the ~ key.

Odd. Try other nominally unassigned keys, such as the semi-colon. See if any of those will work. Try the tilde key with shift engaged, as well.

Check which key it is bound to in Options.

Do you have to have something installed?
Do you need something special installed for the ~ key to work? I have tried it all, nothing bringes it up, reloaded game, looked in options (nothing there about the console) I just cant find it there, do I need the expansion or a mod to make it appear? Is there a mod that makes it appear? Someone please help!!!! PPPLLLEEEAAASSSEEE
Addition to this post
can someone compare my .ini file to theirs that their ~ key works, am I missing something in my .ini...

you don't need anything installed but the original game as far as i know. have you downloaded the patches for the game in case one of those adds the console function?
my game doesn't have the option to turn the console off or on in the options menu so its not that which is the problem.
which nationality keyboard do you have? have you tried other common console activating buttons to see if they work?
edit: try pressing the key directly underneath the Esc key regardless of if it is the ~ key or not. this is the key that pretty much brings up the console on every game i have played

Tried it all
NEW INFORMATION FOUND!!!
Problem solved... Apparently there is a proble with Microsoft Media Center Edition and the IR remote control box, read this quote that I found somewhere else...
Unfortunately, if you are running Windows Center as I am, just hitting the ~ will not pull up the console. The Microsoft Infrared Remote Control receiver needs to be unplugged from the USB port. All this means is that you cannot use your remote when watching anything in Media Center until you plug it back in. Once this has been unplugged you can use the ~ button to pull up the console in the lower left corner of your screen when playing Oblivion and have fun in whatever way suits you best.
Upplugging the IR box from my USB prot fixed my problem... Hope this helps others with the problem,
this might need to be sticky!!!
See ya

Tilde Key problem specific to one game
I have been struggling with an old FPS called "CHASER". First off it had an install bug aggravated by a complete lack of coherent documentation. Once installed on my fairly new MSI gaming notebook with Windows 7 it ran just fine until I attempted to cheat. No tilde key response. I tried it on my Dell Mini9 netbook with Windows XP. Same problem. Installed it on my desktop gaming system with Windows 7. Tilde key works fine there. I have been able to call the ingame console with other games no problem. I am thinking there is some kind of spooky keyboard scanning issue with notebooks and the game may be accessing the hardware directly, which is a big no-no with Windows. I found three programs to remap keyboards. I have not tried remapping the tilde yet. One is an official Microsoft utility. Search for keyboard mapping.

I think I have found a solution for Vista owners that are having trouble with the Oblivion tilde key not working to bring up the console. I was having the same problem and I have tried everything with no avail. Last night I was finally able to fix the issue.
I assume most have windows media center since it comes with vista. That is what is causing the problem. The Infrared Reciever to be exact.
What I had to do:
1: Open up the Device Manager
2: Go to the Universal Serial Bus Controllers tab
3: Maximize the tab to bring up Devices
4: Open the eHome Infrared Reciever (USBCIR)
5: Uninstall it and Restart your computer.
6: Open up Oblivion and your good to go. The console will open with ~ key
