HotU Ice Prison - possible bug

is this a bug (this section of the third chapter of hotu has been acting up and freezing a lot)
when i defeat the waves of warrior devils at the ice prison, and according to the walkthrough, i should get a final guardian (to the knower of names) to do battle with. this guardian does not arrive and if i try to get on with the next part of the game (polymorphing to an earth elemental, throwing the catapult across to the ice prison and breaking the ice to free the keeper of names or release a few more demons to have fun with) i cannot. the message is simply that the battle is still commencing and that i must finish it before i use the item. there is no-one to battle and i cannot therefore finish the battle. it's a bit of a paradox
incidentally, how would i throw the catapult (as an earth elemental) or would this be apparent if the game were running as normal. so, far the only command i seem to have at my disposal is 'use'
