Is it possible to kill all the guards in a town?

Not permanently, they will all re-spawn. Fighting the guards or the Legion is an exercise in futility.

If you assassinated every non-guard member of a town would they respawn?

No, any citizen would die. However, there are citizens who have a significant part later in the main quest of the game, and you can never kill them, you can only knock them unconscious.

You can't kill all the guards, but you can steal most of their weapons and armor. Just go to their barracks and take as much as you can carry. Pretty soon, the guards at that town will be walking around in their boxers or everyday clothes.
