no, time is not the issue. I had plenty of time with him before chapter 4 but I did say to him that it's a party treasure (being evil and all) so I guess that's the thing that ruined my quest.
is there a patch to fix this?

Well I got this game and I never really played it seriously. I don't know why, maybe I played Baldur's Gate too much . I've heard a lot of praise about it but to tell you the truth..it sucks big time!

in one of the challenges in hell at he end of SoA you can get such immunity but it depends on your dialog answer (I don't remember which challenge or if it is granted after an evil/good reply though)

well first THANX!. now I got from 'BG2 & ToB Small Portraits' a small portrait of Balthazar...what should I do now??
I mean I'm not very good in editing pictures so to speak and I need a larger one also.

I was searching for over an hour for a Balthazar portrait cuz he looks neat and I want to play a monk. where, good people, can I find one?
