I certainly think you should upgrade the game. Not only do the new patches fix some minor bugs, they also make the game more fun.

The major change is between 1.10 and earlier versions. The 1.10 patch changed both gameplay and character planning fundamentally. It became more difficult than previously, but also better balanced. Not to mention all the new items!

You can read about the 1.10 patch in this thread:

Because of synergies, it is generally best to install the v10 patch before you start a character.
In memorian: Fiona; Ravager; Lestat; Phreddie; and all of those from the 1500 incident. Lest we forget.

Personally I rather liked 1.09d's gameplay over 1.10 for several small things. The advantages of having 1.10 patch can be looked at in the thread I made named "Good Idea/Bad Idea" a bit back.

Though in a nutshell I think that there are more possible classes and variations in 1.10 than there is in 1.09 but at the same time many old builds will become redundant, meaning if you spend many years building up good classes in the past with older versions of the game then chances are they might not be half as effective with the lastest patch.

Because your monitor is unplugged?
Because you've spilled acid on your CD?
Kinda need to give more informations for us to help you there :P , but my guess is that the patch is failing to install because your game.exe file is write protected.

Go into your Diablo 2 folder and you should find a file that hasn't got an icon, named "Game.exe" (I think it's .exe) right click it and make sure the "Read Only" option is unchecked.

If that's been done then the patch should work.
