Does anyone actually own any of those videos advertised on television where they claim to have caught zany female college students exposing it all on spring break or at mardi gras. Just curious and this seems like the place to ask.

I've always wondered because they seem like the kind of tapes every guy would like to own but nobody wants to call the number. I, for one, have never called the number.

I read an article on the internet somewhere about a girl who is on one of the Girls Gone Wild! videos and she "figures" prominently in the TV spots. Apparently she is suing the production company for invasion of privacy because she did not give her consent to be filmed and is not being compensated in any way.

The author of this article basically said that she has no case since she was out in public and that the filmmakers don't have any obligation to receive her consent or to pay her in order to record her image, much as celebrities cannot receive compensation for appearing on the "news" or other tabloid source, as long as it is in public.

The lesson in public humiliation here is that you shouldn't go to Mardi Gras, get drunk and show everyone your boobs just to get some beads if you don't want everyone from Walla Walla to Key West to see you do it.

I am embarressed to admit it but i know of a site which shows off women doing just that :o I can't recall it's name but my boss has it in his links somewhere :D

@HLD (or any US citizen) i heard that it is illegal to film any member of the public without there consent, what is the actual law concerning this? In the UK you can film anyone anywhere and not fear prosecution....although stalking is still an offence ;)

I am not an intellectual property lawyer (although I know a few) but it is not illegal for a "news" organisation to film you and not pay you. For instance, CNN can take a shot of you walking down the street or the local news can film an interview of a redneck describing how the tornado ripped through the trailer park and sent his enginless '66 Charger to the Great Scrapyard in the Sky and the news does not have to compensate him.

If you go to Disney World, they periodically film commercials throughout the theme parks but they post signs telling the guests that by entering the cordoned off area they are giving their consent to be filmed without compensation. However, I do not know if they are required to do this; it may simply be a courtesy Disney extends to its guests.

In the case of a Girls Gone Wild! video, from what I have seen, they are all shots of people out in public; they are on public property, at a public event and engaging in crowd (or mob) behaviour. Where things get complicated (from an intellectual property standpoint) is that many of the shots shown on TV have the "home-movie" look. So what if the producers of this video paid the "cinematographers" $50 for every pair of boobs they capture on film? Who's intellectual property is it then? Is it the filmmakers (for taking the video)? Is it the producers (because he bought the tape)? Or is it the girls (because they're her boobs)?

Given that these events take place in public, from the gist of the article I was reading, I believe that the law says that you can be filmed appearing in public and do not have to be compensated in any way. We see this all the time in the sort of freelance tabloid journalism that takes place on Entertainment Tonight, Inside Edition, Hard Copy, et al. As I said, I am not an intellectual property lawyer, but I will check with a couple that I know and post any changes that I hear about.

It occures to me there could be an ironic twist if a criminal on Cops or a show of that nature claimed he had intellectual rights over the insane driving he had partaken in, he could end up suing the TV station and paying for his bail with that money :D :D (j/k)

It seems there is a lot of ambiguity in these laws. I only recall all of this because of a video by Fatboy Slim that they weren't allowed to use because of the intellectual ownership laws. They had to film an entirely new one and request everyone's authorisation.

Intellectual property is a very slippery legal slope and the courts (at least in the US) have come down on both the sides of the individuals and the companies who exploit them.

HLD, nice work, girls gone wild , i couldn't remember the title. I couldn't see the young ladies case holding up in court. Interesting tidbit about the FSU calendar. It would seem it is just a publicity stunt, perhaps her grades are lacking (will leave it at that). If she puts up a good fight in court and takes off her shirt, Hefner will probably be at her door before too long.

Here's Becky Lynn; cute girl, plus she already has a centerfold/porn star name. I think I read in one of the stories I checked out that she is an FSU grad (finance and accounting), so she must know something about making money.

Of course, that's they cynic in me talking; she may legitimately feel like she is being exploited. After all, they're her boobs being shown on TV and up for sale, but she's not making any money at it. At least when she poses for a swimsuit calender, she's in control of the situation and not out on a drunken rampage through Mardi Gras with her boyfriend on the quest to accumulate beads.

Still, the courts have upheld decisions that exposing one's self in public does not offer any sorts of protections or entitle anyone to compensation, so I'd say that unless her lawyer can bust out a new precedent, images of her body are going to be appearing in advertisements and Mardi Gras videos for along, long time.
