I Hate The Exp Cap!
my party is all lvl ten and they all stopped even gaing XP when it happaned! this is a serious predicament! my wizard doesn't have enough xp over 45K (the amount to be lvl 10) to craft any sick items! i just got shocking burst and i can't use it b/c ther isn't enough extra XP!
The level cap is a drag, but the game is pretty short, too. Hopefully they'll pop out an expansion or something and jack the cap up to 20.
Re: your dilemma: you will still get xp for killing higher CR foes (albeit less than if you were at a lower level), but you are right that many of the lower CR foes will not earn your high-level party any xp.
At 10th level, trolls are reliable, you'll get a little xp for crayfish, and many of the Temple denizens will earn you xp, but there are a lot of familiar foes that are just stat padding (most consecutive hits, most damage dealt, most critical hits, etc.) fodder at this point - lacedons, skeletons, pirates, bandits, lizards, etc...
What I do is rest in the wild a lot and pray for trolls to attack. Your wizard will get xp and be able to enchant items.

thanks that's great news. i hate levels caps in general. they are so dumb, what they should do it just have it so the creatures in the game yeild only so much xp so that at very high levels killing them yeilds very little xp. but about getting more xp i plan on entriely clearing out the temple, but is too bad b/c i pretty much killed everythign already. if i summon one of the demons w/ the evil skull, can i kill it for XP, b/c that big toad looking thing gave me like 6500 at lvl 9.

I don't know about summoning and killing, but I can tell you how I resolved the lack of XP in the wild. I just went into the temple, down around level 4 and used that as my "Holiday Inn." I just found a room that I liked the look of (I like the one just Southeast of where you rescue Paida) and started resting there. PLENTY of random encounters pop up, so you can still get a lot of XP, as well as plenty of gold. Lots of Ettins, trolls, hill giants, and other higher level creatures come in to say "Hello!" while you are sleeping.
Hopefully that will help you get the XP you are looking for; I know it helped me!

Except to remove the level cap would be an exhaustive amount of work. Once they removed it, everyone would want all the higher level feats, then they'd want the epic feats, and then they'd want spells..but not just some spells, they'd want them all. It would probably double or triple their workload to add all that unimportant stuff in. And it is unimportant, the game is designed to be beaten at that level. Removing the level cap would actually be pointless becuase once you gained a handful more levels you could go no higher because nothing would give you XP.
(even with random encounters via camping, I doubt you could really get above level 12 or 13 before the xp would become completely non existent)
At which point everyone would cry because there is nothing for them to get XP off of...
leave them some room for an expansion pack..
This isn't diablo, its not about mindless leveling

Then I highly suggest you find another game. Unless the game is designed specifically for single character play, its highly unlikely that it would ever be balanced for such play if you wanted to do it like that.
Encounters are normally set up for a wide variety of abilities, and its expected that you'll have access to various methods of doing things.
To even attempt something like that in this game, you'd have to do random encounters and save before each one to even hope of getting anywhere.
I would be surprised if you'd even make it past level 3 or 4 without some extreme luck and lots of reloads.

Well thats fine, but what if you want to play as a fighter? or a wizard?
you might be able to find a single combination of PC, skills, feats, gameplay, etc in order to do it..but its not a generally open gameplay method.
Even a monk is going to end up being surrounded by bugbears in the moathouse, thats not going to go well

see i dont want to be a fighter or a mage
and being surounded by bugbears is what great cleave is for...and if i decide to have a monk fighter, the infamous whirlwind attack!
"War does not determine who is right, it determines who is left"
but you'll run into a problem later on when you can't craft anything for your monk (no wizard powers)
And great cleave only works if you happen to be dropping tons of bug bears...
if you get surrounded chances are they're at least going to get 1 attack each, possibly more, you could easily face 16 attacks before you drop them all (or a majority of them) and teh way ToEE numbers generate, you could be in a world of hurt
