Class Action Lawsuit
In light of Ubi Softs failure to sufficently address issues with its current title Pool of Radiance, I am requesting anyone who is currently unable to play the game properly or has contacted Ubi Soft and recieved insufficent tech support on resolving game issues to contact me with a description of you're problem and E-mail Contact info. I am currently investigating the possibility of a class action law suit against Ubi Soft.

I dont recall anyone jumping on the banwagon to set up a class action law suit aginst bioware when TOB came out and had problems. I personally have not had any problems with this game, I think it is a little early to take this action and not only that come on its a game its not like a builder made a critical mistake on building a house and now the roof caves in on just about every house on the block. thats a class action law suit. Now on the other hand if this game crashed and destroyed peoples operating systems than i think ubi soft should take care of that if it could be proven that the game was indeed the cause. I think trying to sue a game company just because you dont like the game or you cant play the game is not the best idea, just boycott there products and let them see the power of the consumer.

Oh really now...
Yes, the game sucks in many ways.
Yes, many of us are seriously disappointed.
Yes, the producers are perhaps incompetent or just don't care.
But that's no reason to go about trying to sue them, is it?
If you don't like this product, write it off as a lesson and don't buy anything they bring out in the future.
And I think it would help if people took the time and patience to perhaps read a review or two before making a decision about a new game. If I'd read the review about this game, I wouldn't have bought it and saved myself the aggrivation, space, and $35.

You logic is inconclusive, your motives are suspect and your willingness to effectively firebomb the PC gaming industry is irrational. Unless you are doing this out of a scheme to line your pockets you really need to check yourself. If you think that this game is grossly negligent you have no idea of how the game industry or any other industry whose single goal is to entertain operates.
The products of these industries in no way represent essential needs and any opinion on the value of the product they produce is merely that. Authors are not sued for writing a bad book. Stephen King, whom I love, would probably be bankrupt if "Class Action Suits" where filed against him every time some one was disappointed with one of his novels.
You are not serving justice in any way despite what you may believe; such a suit would not effect the quality of the games produced by the gaming industry rather negatively effect the number of investors willing to invest in a project in the making. These are not Hollywood studios you are talking about they can not release a bomb like Corky Romano and walk away from the rubble.
A bad game is not just an unfortunate right off, it is an essential and vital crossroad for the company that produced it. They often represent years of development, during which time no money is coming in from the work they are doing. Movies are shot in about six weeks and if they tank you get another chance next Friday. Very few companies producing PC games have that luxury.
KaaZe is very much correct about this, this mentality is leading once prestigious companies to focus only on consoles. They can not really be blamed, a PS2 is a PS2 while in most cases computers are similar to snowflakes in that they will hardly ever be exactly the same. Writing the game and coding it is probably the easy part. Getting it to run affectingly on 75% of all home computers is most likely excruciating at times.
Think about it, game developers even have to compensate for poor coding and the bugs of other software beyond there own. They have to take in the fact that some Windows build have glaring bugs that cause 3D games to crash or speed issues from sapping all of the memory. They have to think about the failures and screw ups of other companies to no fault of there own.
I have PoR:RoMD installed on my computer and I have not hit a single bug. This is not a singularity either and if you stop to think about it people never think to post messages saying everything is running smoothly. Only if they do hit an error do most people post to a forum. I was disappointed with the game, so what, big deal. I just bought Monopoly Tycoon and I am very pleased with it, you win some and you loose some. You don’t return a book you bought at a bookstore because the author can’t write, it is a chance you take as a consumer.
This is why great companies like Looking Glass have gone out of business. System Shock 1 and 2 as well as Thief are lauded as some of the best computer games written and yet the company will never write another, it is a high stakes crap shoot. You do not need to load the dice against them. And while people may not agree with me, I think a good deal of them would agree that following the attacks on Sept. 11, we should probably encourage companies instead of scaring them into firing more people than have already been fired.
My brother is a Java Programmer whose company was working on a app for GM’s web site and were developing it and going in on it with a large investor who was fronting two million dollars. Nothing was wrong with the product the investors panicked and even though the agreement was made they told them they weren’t going to wire the money. 30 people were laid off and my brother didn’t even no if he was getting a paycheck even though his dev team had been given the responsibility to save the entire company. They pulled through but with loses that could have been prevented if people stopped to think that maybe support, feedback and open discussion might solve problems a lot simpler and cleaner than indignation.
Unless you are in it for the money, if so know that you are nothing better than a vampire or an ambulance chaser, you will stop and think this over
P.S. Anyone who feels that this post may represent a flame and feel that it is necessary to point this out and suggest that I read the rules can complain to the elusive Buck. I am not editing it and I feel complete justification for everything I have said.

Nice editing job, @RIA. The problem is that when 50 people get together up on a board (or anywhere) in an isolated environment and they think alike, they mutually reinforce their own perceptions to the point of losing focus. The PoR boards are a disaster, in that respect. Anybody can and will post anything, and there are quite a few trolls and diehard obsessives who complain endlessly about the game. Why, there were even a couple of people who said they were too angry to return it. What nonsense. If I'd bought an auto that was a lemon, I would return it instantly for my money, and move onto something else. I would not waste my time trying to convince everybody on a board that the company's cars were all lemons.
The idea of lawsuit is ridiculous, in any case. A software development company that produces a game doesn't force a player to purchase their product at the end of a loaded gun, and the contract that's agreed to upon installation specifically absolves them of all guilt to a variety of factors involving (among other things) the psychological health of the client.
IMO, Ubi Soft should shut down all forums except spoilers and tech support, then ruthlessly delete everything that shows up which doesn't fall into those two areas. They're not doing themselves any favors by allowing people like DarkKarma to post regularly.

I dont get it. What is wrong with the game? Works great for me, except the non-healing Baeril person. I dont care since that does not affect the game and never should have affected the game.
The game is a good, SLOW game. Man Lightning bolt is a cool spell to have.
I had problems with Homeworld(Sierra/Relic) and they told me it was my Voodoo3 card. They did not support 3dfx. The Box said it did, THAT is where you go to get a refund or a lawsuit. Not this case.

Before every one bashes me for my motives (too Late) let me explain them. I Have a budget that I live within, I work Hard I pay my bills, I save for a rainy day and occasionally I find that I have a few leisure dollars left over for entertainment.I take those few dollars that I may not have available for a while again and purchase in good faith what I believe to be a working product. However, I get home only to find out that not only dose the product not work but that the company that made it has no interest in solving my problem or refunding my money. So now I sit with a program which I can not use and not recieve my money back for. All I am told is that someday there will be a patch that may fix the problem. If you bought a car and once you got it home found that it would not work because the company could not figure out the problems with it at the time but wanted to get the product out and told you dont worry well fix it eventually... You would be mad (to put it nicely) Oh but wait there are so many different variables with a computer each is so different we cant account for all the problems. would you accept that answer with the car exmple (apply it to other products). And ok I say I understand that this was an unexpected problem.. May I have my money back , since I am unable to use you're product... No was the answer I got. Repeted attempts to trouble shoot the program with the company were also a bust. So Here I sit with a program I thought would be fun and I can not even play it. And I am unable to purchase something in the meantime because I choose to spend my leisure dollar on this product. AND I am not alone, I read the boards waiting for a patch and I see lotts of messages of people that are having the same problems as me. No I DONT WANT TO GET RICH SUEING UBI SOFT. NO I DONT WANT TO GIVE THE DEATH BLOW TO AN ALREADY AILING INDUSTRY. What I do want is either a working product or my money back . So very simple a request. And yet asking them brought such contempt and disdain from the company that I found my self writting my original post on this board. I am not littigation happy , the thought of such a process for such a matter is trivial. But I am a consumer who has made an investment in a companies product and feel that I was ripped off. I do expect accountability> No One on this board will have less expected of them in any of there choosen proffesions. That is all I ask for.

Problems I have encountered with this title.
1) Windows files were critically corrupted upon installing. After 3 hours of trying to get my system up and running again, I finally had to admit defeat. Wound up having to wipe the hard drive and start over. Unfortunately, I lost a couple of virtually irreplaceable work files.
I refuse to try re-installing it. I agree with most peoples posts that a lawsuit would be pointless. This is not a forgiving business and UBI's rep has been damaged quite a bit (Quite well deserved imo). Sales on any future titles they may come out with would be dissapointing at best. The first nail might just have been driven into the coffin when they released PoR

Good for you Dark Karma!
Too often we consumers take it in the shorts and say NOTHING. Many people are complete sheep and put up with bad products and services from companies.
However, I don't know if a Class action lawsuit will get you the satisfaction you want.
My weapons of choice are letters and recorded phone calls.
I have had great success with companies by writting good letters of complaint. Type a business letter and mail it in a business envelope. Keep it short and to the point (one page). Don't be afraid to let them know you are PO'd!
Phone calls are usually vapor unless they are recorded (you must get the other parties consent). Get the other parties name and direct number. Use the recordings to keep from being bounced around from department to department. By recording a conversation I saved $800 once, it's a long story.
Go up the chain of command. Many times the person on the phone has no power. Insist on their boss, then insist on talking to their bosses boss.
Lastly, know what you want out of the company. What will satisfy you? A refund? Money to fix your computer? know what you want and tell THEM what will satisfy YOU.
Keep at them and good luck.

as much irritation as this game has caused, and it has caused plenty, i still dont think that a lawsuit is worty of it. i mean, its on the same level of buying a ticket to see the two headed midget man (which you know is fake) and then seeing it,and its fake, and being mad about it. i knew it would suck, it really really sucked, and it cost me $40 to find out how much of a pain in the ass it was. live and leanr and stick with interplay games.

I my self tried playing it for the 10th time bout a week ago....and it was such a shamefully painful experience that I WILL NOT PLAY IT AGIAN...i actually got so mad i started sending them emails about why i am so mad and how i will not spend $ on them again....i make it clear that they let down a large number of AD&D fans who don't take no bs...now in the last week i have sent it to them 15 times...i'm not sure but i'm thinking at least 100 of these emails they shall recieve from me..who knows maybe 1000
now i have bought poopy games be4...lots on consols...thats why i migrated to pc's...but why i am really mad (i think why alot of peeps are mad) is because its such a discrace to AD&D...you cant take such a wunderful thing like AD&D and rub it in the mud so badly and not expect to see peeps mad about it...
IMO its wronge to sue any company for things like producing bad products...unless they cause bodly or property damage/harm...now in cases such as this it's way better to simply voice (your right) about how mad you are...and probily not here...the peeps that need to hear it are the ones responsible...and so i keep sending those emails

Ok, to the dude who started this. Face it you just lost $40, because of some problem that a handful of people are having. Just drop it and sell it back to the store so the can sell it used. And R.I.A you're awesome, I agree with you all the way. Unless you're just looking for a quick buck you have no motive. And I admit the game is seriously lacking in the role playing department but it's still a playable game. And to whomever wrote the comment about Thief, that game rocked, I sucked at it but it was still the best game i ever played. And they made theif 2, and someone else came out with some game about stealing the crown jewels of england or something and that looked like it.

I personally havent ran into to many problems with POR at all aside from it being a little slow, not being able to fall into the ancient dwarven tomb, and some pathing problems the game seems fine to me. Hasn't messed with any of my other files on the computer either. To who ever it was that said they had to wipe their hard drive and reinstall everything if a game installation did that then their was something way wrong before the installation. As for the guy wanting a lawsuit, well I doubt it should have just took the game back to the store and gotten your money back then. I mean honestly if anyone deserves to be in court it's microsoft, for putting out products that they know aren't stable and using the public to test the products out on while charging them just to use the software. honestly if GM put out a car they knew was faulty they would be in up to their a$$ in lawsuits and forced to fix the problem or refund the people for the car. Although just as a counter argument having a lawsuit against a smaller company that is doing the same thing microsoft is, but not having the money behind them and winning it would spell doom for any software company putting out shotty error filled products. (its called precedent)

To Dark: Hey you know that this is the way it goes sometimes, you can't help it but it happens. You just have to take it on the chin and move on.
You even said that the store you bought it from offered to replace it with the same title. Do you honestly think you could win a class action lawsuit without trying that first? I mean I have bought cd's, console video games, dvd's, etc., that have not worked. I didn't want to bring up a lawsuit over it. 10 times out of 10 I took it back to the store I bought they replaced it for the same title and the new one worked just fine. The store said they would exchange it you better try that first before the embarassment of a lawsuit.
Not tryin to be rude just saying that you haven't tried all your options so your lawsuit would get laughed out of the courtroom. Every now and then you get bad games but I would almost best if you exchanged it that it wouldn't happen again.
You even said that the store you bought it from offered to replace it with the same title. Do you honestly think you could win a class action lawsuit without trying that first? I mean I have bought cd's, console video games, dvd's, etc., that have not worked. I didn't want to bring up a lawsuit over it. 10 times out of 10 I took it back to the store I bought they replaced it for the same title and the new one worked just fine. The store said they would exchange it you better try that first before the embarassment of a lawsuit.
Not tryin to be rude just saying that you haven't tried all your options so your lawsuit would get laughed out of the courtroom. Every now and then you get bad games but I would almost best if you exchanged it that it wouldn't happen again.
