Is tribunal selected in your data files menu? If not you have to use the launcher and select it

He said he's on Xbox.

They may take some time but they'll come in the end. Go rest in the wilderness. That worked for me.

I thought it only worked if you reached a certain level

It helps (but it isn't necessary...I think) to have beaten the morrowind storyline. It is not level dependent, but the chances of it happening increase with level. you should do the east empire quests or something until it happens.
"Of humble birth, he entered the Emperor's service in the lowly status of courier. Dispatched to Balmora in the waning years of the Third Era, he arrived in Morrowind, ignorant of the role he was to play in that nation's history."

It's based on either your level or your reputation/fame (pretty sure it's level, but reputation would make more sense).

I've been attacked when still first level, outside the ancestral tomb. It's completely random, just rest for a few hours with your back to something so they can't spawn behind you. Keep doing it until they turn up.

Once they start attacking, I put off telling the guards, so they keep randomly spawning....good way to collect items to sell... :D
