I have recently finished the OC and SOU of Neverwinternights and I will start HOTU but I wonder if one can get to level 40 before ending HOTU.
If one gets stuck at level 30ies then what is the use of level 40 cap?

Can one see level 40 in HOTU
You can't reach L40 by playing normally. You'd need to reimport/replay or cheat your way to it.
L40 is as much in the game for multi player, custom modules etc as it is for HotU.
And if people could reach L40 "fast" in HotU, then people would want an even higher cap, so for HotU specifically, placing the level cap higher then achievable was a smart move.

Well, actually, Considering HoTU has random encounters when resting, it is quite possible to reach level 40. Though, considering it's like a 20% chance of an encounter of an enemy at least six to nine levels below you, that'd probably take hours upon hours to accomplish.
