If your familiar dies, you lose a point of Constitution. Has it been dieing a lot?

If not that, could it be that you're under a spell effect? If so, try to rest or cast dispel magic or remove curse on yourself.

Yes. That is why you keep it in your backpack when you don't need it. :)

There is the Girdle of Fortitude, which sets your constitution to 18 for eight hours. It can be obtained at the end of the Unseeing Eye quest, in the sewers beneath the Temple District. It's likely to be tough for you to get it though, and it wont prevent you from dieing if your familiar dies again. I think your best bet is to bite the bullet and start again.

Well if you already have the belt and the pale green Ioun stone, you should be able to make it through, just make sure you keep your familiar in your back-pack.

Yes you can make a new character in Throne of Baal if you so wish.

Well, this is cheating, but then if you would reload the game every time your familiar gets killed, it has the same effect. You might want to consider using the CLUAConsole and set your Constitution back to what it was you started with... since it is obvious you did not know about the permanent loss.
