i was playing ToB last night(i was in Watchers Keep) and everyone but Anomen and my main character got imprisoned, and i was able to get everyone freed aside from Kelsey. is this because he's a mod and he's not *actually* part of the original version or something? when i reloaded a quicksave while Kelsey was still imprisoned, yet when the game was loaded and such, it still said that he was protected from evil(he has the staff of the magi). so yeah, what im trying to figure out, is if character mods are doomed if they're imprisoned.

Even though Kelsey is a MOD character, my hunch is that he's treated like any other party member. For comparison, think of multiplayer characters who are neither the main PC nor in-game NPCs.
My guess is that when you cast Freedom, you are actually freeing him from Imprisonment, but you can't see him because he's invisible since he's carrying the Staff of the Magi. Try casting True Sight, True Seeing, Detect Invisibility, etc., and see if that helps.

This isn't really an ideal comparison, since Kelsey has extensive dialog which multiplayer-created NPCs lack. A better comparison is probably "any of the original Bioware NPCs."
He should function similarly to any of the other NPCs, and you're right, it's fairly likely that the invisibility is preventing him from showing up.
