is it a bug?...
no matter how much i try and get flamestrike and fireball or any other fire spell i can think of i cannot use flaming burst with a level 10 wizard. any suggestions?

As weird as this will sound, you need to be level 12 to use the flaming burst ability. And yes, that's impossible since the max level you can reach is 10. So how do I know this?
Look in your Temple of Elemental Evil folder on your hardrive. Look for a subfolder marked data, and then another inside that marked rules. Look for a file called item creation, and open it with notepad. This file shows what's required to craft each magic item in the game. It's a little hard to read through at first, but you'll get the gist of it after a few minutes of looking through it. Strangely enough, the level required for flaming burst is 12.
Maybe if you try changing the value in that file to 10 or less instead of 12 it may work. Or maybe it was set to 12 for a reason because the flaming burst ability is bugged and they didn't have time to fix it. I don't know.
