According to Steve Moret from the Troika Games, lead programmer of ToEE:
I've been holding off posting about this for a while now, but seeing as Atari doesn't want to respond to my questions as to what’s going on from their end I'm going to let you guys know what has happened on my end.

On the morning of April 12th, 2004 I e-mailed the ToEE producer at Atari what we hoped to be the final beta of patch 2. Verifying that he did receive it, that producer wrote back indicating he was going to try and get it into testing as soon as he could.
Steve posted about this on Atari's ToEE board this morning, here.

Thank you very much~

It's really funny how I played Diablo (all of them) and they had no problems getting the patches out. Now I am watching my honey play his game and it boggles me sometimes because you notcie certain quirks in the game and there isnt a second patch yet for it. I never knew a company was sooooo slow on issuing a 2nd patch for a game they produced! I find it very weird!

The reason it has taken so long is that neither Atari or Troika are officially/actively supporting this game. They still own the rights and can and will sue anyone who does anything to the game without thier ok. But the only support is from one guy from troika who did the second patch in his spare time.

As he stated in that thread over on the other board he's only waiting to hear from someone at Atari so that he can put the 2nd patch out.

He also mentioned that he's already started work on a 3rd patch, with the way Atari is dragging thier feet on this I don't expect to see that one until sometime next year.
