has anyone gotten the "assertion failed in ChDataTypes.cpp at line number 250" and if so how do you get game to work.

Well where exactly are you getting it? I had a problem along those lines, but it wasn't in SoA.

Happens in the docks district when entering one of the doorways. Also occasionally when going through a loading screen. I ended up reinstalling the game with no read ahead cache on the disc drive, seems to work fine now in case anyone else has similar problem.
