NPC Spell acquisition

I've been reading many of the threads and may have missed an answer to this. One annoying feature is that the AI "picks" Spugnoir's new spells when he/mygroup levels up. I added him when my party hit 2nd level so I could have 2 mages and not have to multiclass. When my party hit 5th level the AI gave Spugnoir 2 new spells at random, one of which was Cone of Cold (a 5th level spell he can't use yet). I took Fireball for my mage and thought well I will just make a scroll and give it to him. Well, he copied it just fine but it is ALSO listed as a 5th level spell in "his" spellbook. Is this a known bug, I didn't see anything about this before.

The co8 mod allows you to level up npc's as pc's, meaning you get to decide how they level up. Liv's mod might incorporate this too, AFAIK, but maybe not.

Anyway, his learning cone of cold at levelup is definitely a bug, as you're not supposed to be able to gain spells you can't cast yet by levelling. Don't know why fireball is level 5, unless it's metamagicked somehow. I've said it before and I'll say it again, no good comes from using npc's in this game. They bite.

...but with co8, they may be better.

Well,

I suppose that is true regarding NPC's but I just couldn't resist the temptation of having a 2nd full fledged mage, especially since he only wants mage scrolls as payment. If he does find a spell I want/need I have him learn it and make a scroll and then I copy it. Doesn't cost much that way and gives my mage more freedom in picking spells when she levels up. I waited till my group leveled to 2 so they would all be at the same point together. Oh well I've gotten use to him so I hate to ditch him. I confess I liked the NPC when I ran this module year's ago and that was probably an additional factor in this. Thanks for the help.
