Sorry I had to delete your link, Blades Edge, but from what little I can tell, Ubisoft currently owns the rights to the entire M&M series. At least some of the titles continue being sold in bargain bins, and Ubisoft is one of the foremost supporters of the ESA, which protects old games still under copyright.
As to the site that allows you to play the title online: I suspect they will be contacted by ESA, at least, if they're located in the US. The ESA folks carefully monitor abandonware sites for any signs of copyright infringement.
As for M&M X: I've seen on word of a legit game in the series. Dark Messiah certainly isn't: it's just using the brand name to stir up interest, but contains no elements from the original. (The quotes I've read of the developers lead me to think they've never even played an RPGs that weren't console-based.) Too bad, because it was an excellent series, at least until M&M IX.

Heroes of Might and Magic 5 is still being worked on by Ubisoft. They made a decision to not use the Starforce copy protection that has the potential to cause computer damage.
I'd rather be part bull than a complete sheep.
